Signarture Pty Ltd (“Signarture”, “we”, “us”) is a registered Australian Company, ACN 116 872 194. We encourage you to read these Terms of Service and to contact us if you have any questions. If you do not agree to these Terms of Service, you must not use our website in any manner.

 

your order

The placing of an order with Signarture by the person, or entity, entering into the sale contract (“the Buyer”, “you”, “your”) is an acceptance by the Buyer of an offer by Signarture to sell the goods on the terms and conditions outlined in this document. These Terms of Service apply to all sales of Signarture’s goods despite any contrary terms which may appear on any documents put forward by the Buyer or its agents

 

As all Signarture’s artworks are custom made to order, orders received by Signarture are irrevocable and cannot be altered by the Buyer.

 

Signarture reserves the right not to accept your order in the event that we are unable to obtain authorisation for payment, where we suspect fraudulent activity. Orders to which a trade or promotional discount code has been applied are subject to verification of trade status or eligibility. Signarture reserves the right to refuse orders to which such discounts have been incorrectly applied. Promotional orders are subject to the terms and conditions applicable to that promotion. Trade orders may be subject to minimum purchase requirements and/or trading terms as agreed with the Buyer. We reserve the right to refuse to process or refuse service to anyone at any time at our sole discretion.

 

If delivery of an order placed online will result in unacceptably high freight charges to Signarture, such as to addresses classified as ‘remote’ by our freight agents, we reserve the right to contact the Buyer to request additional monies to cover this. Where the Buyer is unwilling to pay such surcharges, any payment received will be refunded in full.

 

delivery

After placing an order online for which payment has been processed an email is sent to the email address provided, conforming receipt of your order and the address you provided for delivery. If you do not receive this order confirmation, you should contact us directly as you may have entered your email address incorrectly.

 

You should verify the delivery address, which must be a street address where the Buyer, or their representative, can sign for the delivery during normal business hours. If this address is unattended when delivery is attempted, or has been incorrectly advised, Signarture reserves the right to charge the Buyer a re-delivery fee. A contact phone number is required for all orders and will be provided to our freight agents to facilitate your delivery. Should you elect to have the artwork delivered to your address when unattended, i.e. not to sign for the artwork delivery, you waive all rights to any redress for loss or damage through us. 

 

Any delivery dates advised by Signarture to the Buyer are indicative only. Signarture shall not be liable for any loss or damage howsoever resulting from any delay in delivery and the Buyer shall not be relieved of any obligation to accept or pay for the goods by reason of any delay in delivery. 

 

returns

As our artworks are custom made to order, we cannot accept returns or issue refunds for any change of mind.

If the goods are clearly damaged when delivery is attempted, you, or your representative, must refuse to accept the delivery from our freight agent, who will return the consignment to their depot. If the packaging is damaged, and you, or your representative, have reason to believe the contents are damaged, you must sign for the goods only after noting "damaged in transit" on the freight agents' delivery documentation. 

In either circumstance, or should you claim that the goods are defective, or have been incorrectly supplied, you must advise us within the next business day of the attempted or received delivery. You will be required to supply us with clear photographic evidence of the product and packaging, such that we can assess the alleged defect or damage, and communicate with our freight agent or other partners as applicable. 

Where it is confirmed, to our reasonable satisfaction, that any defects or damages alleged by the Buyer are attributable to Signarture or its freight agents, collection for repair of the defective or damaged goods, and delivery of replacement or repaired goods, will be arranged at no charge. 

You must retain all the original packaging for the return of the goods.

warranties

To the extent permitted by law, Signarture makes no warranties in relation to the supply of goods. In procuring Signarture’s products or services, the Buyer relies upon their knowledge and expertise or upon independent advice. Signarture shall not incur any liability to the Buyer for any advice, recommendation, information or assistance supplied.

 

The Buyer accepts that, due to the nature of the print production process and variations in colour calibration of monitors and printers, the colour and appearance of the final goods may vary, within commercial tolerance, from that of any images displayed or samples supplied. In illustrating how the canvas prints wrap around the edge of the frame, some distortion of the print may be apparent in the image displayed on our website that will not be present in the canvas print that you receive. The Buyer accepts the risk of such differences and Signarture will not accept the return of such goods. You are encouraged to request our Colour Guide or, where colour matching is critical to you, to order a proof of your artwork ahead of purchase.

 

Nothing contained in this warranty shall be read or applied so as to purport to exclude, restrict or modify or have the effect of excluding, restricting or modifying the application to these terms of the Provisions of the Competition and Consumer Act 2010 (Cth)or any relevant State or Territory statute which by law cannot be excluded, restricted, or modified. However, to the extent that any such statute permits Signarture to limit its liability to compensate or indemnify any person for breach of condition or warranty implied in these terms and conditions, then the liability of Signarture for such breach shall be limited, at the election of Signarture, to either the replacement or the goods; the repair of the goods; the supply of equivalent goods; or the payment of the cost of repairing or replacing the goods or supplying equivalent goods.

 

handling, installation and care

All artworks need to be handled with care on receipt, during installation and thereafter. The Buyer is responsible for reading and following any installation instructions provided and the installation and care advice published by Signarture in the FAQ's section of this website.

 

copyright

Copyright for all artworks is owned by Signarture. The sale of goods does not include nor convey to the Buyer any intellectual property, such as copyright, designs, trademarks or similar. All images published on the website, supplied for review prior to order and all goods supplied by Signarture will at all times remain the intellectual property of Signarture. Reproduction of artworks owned by Signarture in whole or part constitutes an infringement of copyright.

 

Signarture has the right to sell additional editions of all artworks to other Buyers up to the specified edition limit for the artwork. Edition limits apply to each colour and format of a design.

The Privacy Policy available on this website informs you of our practices regarding the collection, use and disclosure of any information we collect from or about you. Our Privacy Policy forms part of these Terms and Conditions.
